Can an international company employ people in South Africa without setting up a local entity?

Yes.

US, UK, European and other international companies can employ people in South Africa through InfraLayer's South African EOR partner without establishing their own South African employing entity.

The EOR partner is the legal employer and issues the South African employment contract. InfraLayer manages the EOR relationship and the client-facing employment, payroll and HR administration within the wider engagement.

Does the client need its own South African entity?

No.

Employees are legally employed through InfraLayer's South African EOR partner, so the client does not need to establish its own South African employing entity.

Who is the legal employer?

InfraLayer's South African EOR partner is the legal employer.

The employee works within the client's management structure, but the local employment contract is issued by the EOR partner.

Does InfraLayer use an EOR partner?

Yes.

InfraLayer partners with a South African EOR specialist to provide the local legal employment framework.

InfraLayer manages that relationship as part of a wider model that can also include talent sourcing, payroll administration, equipment, connectivity, power resilience, technical support and workspace.

Is InfraLayer an Employer of Record?

InfraLayer is not a standalone or software-only Employer of Record.

Legal employment is delivered through InfraLayer's South African EOR partner. InfraLayer combines that employment layer with talent sourcing, technical infrastructure and Cape Town workspace where required.

Who manages payroll and statutory deductions?

Payroll and local statutory administration are processed through InfraLayer's South African EOR partner.

InfraLayer manages the client-facing payroll and employment administration within the wider engagement.

Can employees receive bonuses, commission and benefits?

Bonuses, commission and benefits can be included where they form part of the agreed employment package and can be administered through the local employment framework.

The details are confirmed before the employment contract and payroll setup are finalised.

Who manages leave and employment administration?

The client approves leave requests operationally and manages team coverage within its business.

Statutory leave entitlement, leave records and formal employment administration are managed through InfraLayer and its South African EOR partner.

Who handles disciplinary, grievance and termination processes?

The client manages day-to-day performance, objectives and operational feedback.

Formal disciplinary, grievance and termination processes are managed under the South African EOR partner's employment framework, as the legal employer, with input from the client and coordination through InfraLayer. The client must not issue formal warnings or terminate employment independently.

Is an upfront deposit required?

Yes.

A refundable payroll security deposit is required before employment begins. It is normally based on one month of the employee's agreed salary and is held to protect payroll continuity if a client payment is delayed or remains unpaid.

The deposit is not an additional fee and is not automatically applied to the final month of the engagement. If any amount is used, it must be replenished. The remaining balance is returned after the engagement ends and all employment-related liabilities have been settled, subject to the client agreement.

Can InfraLayer source employees in South Africa?

Yes.

InfraLayer can source South African professionals against the client's role, experience and communication requirements.

Talent sourcing forms part of building the client's South African operating capability rather than a standalone recruitment service.

Does the client interview and select the employees?

Yes.

The client controls interviews, assessments and final selection. InfraLayer can support sourcing and initial assessment, but the client decides who joins the team.

Which roles can InfraLayer source?

InfraLayer can source suitable South African professionals across Finance and Accounting, HR and People, Technology and Data, Marketing and Digital, and Operations and Transformation. The same infrastructure model can support one role, a functional team or broader capability.

Availability is assessed against the specific role, seniority, experience and working requirements. InfraLayer is not designed around high-volume customer service, call-centre operations, very junior general administration or roles requiring constant local supervision.

Who manages the employees day to day?

The client manages the employees day to day.

Employees work within the client's management structure, on the client's systems and under the client's operational direction.

Who provides technical and role-specific training?

The client provides technical, systems and role-specific training.

InfraLayer manages local onboarding, employment administration and access to agreed local support.

Who controls systems, access and information security?

The client controls its corporate systems, application permissions, device-management policies, access rights, information-security requirements and technical standards.

Where agreed, InfraLayer can procure and coordinate local support for the physical equipment against those requirements and work with the client's IT team on device deployment.

Does InfraLayer manage the team's operational output?

No.

The client allocates the work, sets priorities, manages performance and remains responsible for the operational outcome.

InfraLayer provides and manages the agreed local employment and operating infrastructure around the team.

Is InfraLayer a recruitment agency?

No.

A recruitment agency typically sources people, after which the client remains responsible for arranging local employment, payroll and the wider working environment.

InfraLayer can source South African professionals as one part of a broader model that also provides local employment through its EOR partner and the agreed operating infrastructure around the team. The client interviews, selects and manages the employees.

Is InfraLayer a BPO or outsourcing provider?

No.

InfraLayer does not take over the client's business function or manage its output. The employees remain dedicated to the client and work inside the client's management structure.

Can one South African team support several business units or entities?

Yes, where the client has clearly defined the roles, reporting lines, processes and performance measures.

The client remains responsible for managing the team and allocating work across the relevant businesses.

How are data protection, confidentiality and intellectual property handled?

The client retains control of its systems, access rights and information-security requirements.

The contractual framework addresses confidentiality, intellectual property, South African POPIA, UK GDPR where applicable and relevant cross-border data-transfer requirements. US, European and other client or jurisdiction-specific security and privacy requirements are agreed before onboarding begins.

Can employees work fully remotely?

Yes.

InfraLayer can support remote employees with locally procured corporate equipment, agreed connectivity, power resilience and local technical assistance.

The working arrangement is designed around the role and the client's requirements.

How is employee equipment provided?

InfraLayer can procure corporate-grade equipment locally in South Africa against the client's agreed technical and security requirements.

Local procurement avoids international shipping and customs delays and allows hardware faults, warranty claims and replacement requirements to be handled in South Africa.

The client retains control of device-management policies, corporate applications, systems access and information-security standards. The equipment specification, funding, ownership and replacement arrangements are confirmed before onboarding begins.

Can InfraLayer provide connectivity and backup power?

Yes.

Depending on the engagement, InfraLayer can arrange managed connectivity and backup power for remote employees or workspace-based teams.

These measures are designed to reduce operational disruption, not to guarantee uninterrupted operation.

Is power reliability still a concern?

Power resilience still needs to be planned for when building a South African team.

What is needed depends on whether the team works remotely or from a workspace and on the client's operating requirements.

Depending on the setup, InfraLayer can provide agreed backup power, connectivity and workspace resilience to reduce the risk of disruption.

The aim is to reduce disruption as far as practical. InfraLayer does not guarantee uninterrupted operation.

Can InfraLayer provide office space in Cape Town?

Yes.

Professional Cape Town workspace and dedicated team environments can be provided where required.

Workspace is an available infrastructure layer, not a requirement for every engagement.

Can a team begin remotely and move into workspace later?

Yes.

A team can begin with a supported remote model and add professional workspace as headcount and operating requirements develop.

The client proposal and monthly Infrastructure Fee are updated to reflect the additional workspace and operating infrastructure when it is introduced.

How do South African working hours align with international teams?

South African teams can work closely with UK and Western European colleagues because there is typically no more than a two-hour time difference, depending on the client's location and daylight-saving period.

US overlap varies by time zone and working pattern. East Coast requirements generally offer the strongest live collaboration window, while Central teams can also support meaningful overlap through an agreed schedule. Other North American time zones may require adjusted South African working hours.

Working hours and any required shift patterns are agreed with the client before employment begins.

What happens during an equipment, power or connectivity problem?

InfraLayer coordinates the agreed local support and resilience arrangements.

The response process depends on the equipment, connectivity, backup-power and workspace provisions included in the engagement.

Infrastructure arrangements are designed to reduce operational disruption. The exact equipment, connectivity, power resilience and local support commitments are confirmed for each engagement.

How established is South Africa as an international offshoring location?

BPESA reports that total headcount in South Africa's Global Business Services sector grew from 65,000 in 2019 to an estimated 150,000 in 2024. The UK remained the largest source market for globally focused delivery in BPESA's 2025 reporting.

BPESA also reports that the share of globally focused South African GBS workers servicing the US market increased from 1% in 2019 to 33% in 2024, while total sector market revenue increased from $1.04 billion in 2019 to an estimated $2.91 billion in 2024.

Those figures show the scale of the market, but they do not tell a client what its own South African team will cost. That depends on the roles, seniority, employment package, infrastructure and operating model.

How does InfraLayer pricing work?

Pricing is structured around one recurring monthly Infrastructure Fee per employee.

The core Infrastructure Fee is based on the employee's agreed salary and benefits, the local Employer of Record cost and InfraLayer's management margin.

Equipment, connectivity, local support and any workspace requirements are included in the client proposal. Depending on the engagement and contract term, these costs may be reflected in the monthly Infrastructure Fee or shown as separate setup items.

A remote-first employee may not require workspace. If the client later adds Cape Town workspace or broader operating infrastructure, the proposal and recurring monthly fee are revised to reflect the expanded arrangement.

Is there a minimum team size?

A client can begin with one employee.

Any practical or commercial minimum connected to a particular workspace or infrastructure arrangement is confirmed during the proposal process.

Is talent sourcing charged separately?

The sourcing terms are confirmed in the client proposal.

Talent sourcing is provided as part of building the client's South African operating capability rather than as an isolated recruitment service.

How long does it take to establish a South African team?

The timeline depends on whether the people have already been identified, the roles and experience required, availability in the South African market, employment onboarding, equipment, connectivity and workspace requirements.

The time needed to build the team depends on the roles, seniority, the availability of suitable people and any notice periods.

A proposed timeline is confirmed once the requirement has been defined.

What contract terms apply?

Contract terms depend on the team size, working model and infrastructure commitments.

Remote-first engagements will normally have an initial fixed term followed by a notice period. Where InfraLayer provides dedicated workspace or other client-specific infrastructure, a longer minimum term may apply so that those commitments can be aligned with the client agreement.

The proposed term, notice arrangements and any early-termination costs are set out clearly before the engagement begins.

Can the team expand over time?

Yes.

A client can add employees, functions, equipment, support or workspace as the requirement develops. The same operating model can support the team as it grows.
